On April. 9, 2025, Professor Carpenter presented his new research project to the faculty at the Loyola University Chicago Law School. Prof. Carpenter’s project, The Prospection Problem with Selecting Capital Jurors, is an original empirical study that addresses the problems courts have when selecting jurors for death penalty cases. During voir dire, lawyers ask venirepersons if they will be open to both possible sentences (death and life without parole) at a point in the future–at the end of the merits phase of the case. However, prospection theory suggests that people have difficulty making accurate predictions in situations like this. In this study, participants were given different degrees of information to see if they would improve the accuracy of their forecasts. Prof. Carpenter’s coauthors are Dr. Deborah Goldfarb and Dr. Ayesha Bhakta from the FIU Legal Psychology Department.
