Professor Elizabeth Price Foley, a Constitutional Law specialist and one of the founding members of FIU College of Law, recently shared her knowledge in The Wall Street Journal. The Op-Ed she authored “A Supreme Court Remedy for Nationwide Injunctions” centers around the increasing use of nationwide injunctions by federal trial judges, which create tension between the executive and judicial branches, particularly under the Trump administration. Professor Foley argues that these injunctions, often seen as politically motivated, undermine the separation of powers, erode judicial legitimacy, and allow lower courts to impede presidential authority. In addition, she highlights the concern that the current system of nationwide injunctions is damaging the constitutional system and calls for immediate reform by the Court.
