A recent executive order seeks to end birthright citizenship for children born in the United States to undocumented immigrants. Legal scholars note that the U.S. Supreme Court has consistently upheld birthright citizenship under the 14th Amendment in cases such as Wong Kim Ark, Afroyim v. Rusk, and Plyler v. Doe. These rulings affirm that individuals born on U.S. soil are citizens, regardless of their parents’ immigration status, and interpret “subject to the jurisdiction” to include all who are governed by U.S. laws.
