The executive order, which sought to deny U.S. citizenship to children of non-citizens, was temporarily halted by a federal judge in Seattle, who deemed it “blatantly unconstitutional.” During his interview, Professor Román explained that while this ruling is a setback for the administration, the case is expected to be appealed and could ultimately reach the U.S. Supreme Court.
“In the eyes of the Trump administration, they will hope for the conservative supermajority to be more political than legal and disregard over a hundred years of precedent to overturn birthright citizenship,” Román stated.
The discussion highlights the ongoing legal battle over the 14th Amendment, which has guaranteed birthright citizenship since its ratification in 1868.
