Gabilondo Named One of 50 Most Influential Minority Law Professors

Lawyers of Color (LOC) recently selected the 50 most influential minority law professors, who are 50 years old or younger. The Florida International University College of Law is very pleased to announce that José Gabilondo has been named to this exceptional group.

LOC published the 1st annual edition of “The 50 Under 50 List” on May 15, 2013. The publication is available online and features profiles of these brilliant law professors. The publication also includes the names and racial and ethnic heritage of all minority law professors at 200 law schools and a comprehensive list of scholarships, fellowships and interns available to minority prospective and current law students.

Profesor Jose Gabilondo Analiza el Derecho a Matrimonio en CNN

El 26 de marzo, Profesor Gabilondo salió en el programa Dinero de CNN en Español para analizar Hollingsworth v. Perry y United States v. Windsor, dos casos en Tribunal Supremo que impugnan las restricciones federales y estatales sobre el matrimonio civil por parte de personas del mismo sexo.

“Nuestra Constitución reconoce dos distintas fuentes de derecho – una democrática y la otra judicial.  La mayoría de las leyes se promulgan a través de la primera por los procesos mayoritarios, i.e., las legislaturas estatales y el Congreso.  Pero cuando el demos se convierte en una turba, la única forma de proteger a las minorías de los abusos mayoritarios es a través de una intervención judicial en la cual una corte – típicamente federal – acredita los derechos del individuo.  Eso es lo que está en juego en los casos Perry y Winsor.”

FIU experts on Same-Sex Marriage and Supreme Court Rulings

For two days in March, the U.S. Supreme Court heard arguments regarding landmark cases about same-sex marriage. On Tuesday, March 26, U.S. Supreme Court justices heard arguments regarding California’s Proposition 8, which was approved by voters in 2008 and bans same-sex marriage. A day later, justices heard arguments regarding the constitutionality of the 1996 Defense of Marriage Act. DOMA prohibits federal recognition of same-sex marriages.

FIU News sat down with two university professors to learn more about the issues being debated.

Gabilondo’s Essay on Heterosexual Supremacy Published

FIU College of Law Professor Jose Gabilondo’s essay, Los Fueros de la Heterosexualidad en Su Ocaso (The Twilight of Straight Supremacy), was published in “La Discriminación de Género en el Derecho y Sus Expresiones en la Legislación y en la Práctica Jurídica (Gender Discrimination in Law and Its Expression in Legislation and Legal Institutions), published by the Association of Cuban Jurists in Havana.

“What’s interesting about this stage of the gay rights movement is that the burdens of proof and persuasion are shifting – from the shoulders of advocates of equality to those who continue to argue that heterosexuality is somehow superior or otherwise worthy of subsidy or special treatment by the state. Straight supremacists will have a tough time meeting those burdens, but that is the way of all social progress,” said Gabilondo, while describing the essay.

Gabilondo’s work on heterosexual subject formation in law and has appeared in the Wake Forest Law Review, the Wisconsin Journal of Law, Gender, and Society, and the Boston College Journal of Law and Social Justice.  His work on heterosexual identity has been used in diversity trainings for the Florida court system.

The Fiscal Cliff: What You Need to Know in Plain English (and Spanish)

Before joining the Florida International University College of Law, Professor José Gabilondo served in the Department of the Treasury’s Office of the Assistant General Counsel for Banking and Finance, where he advised the Bureau of Public Debt, the Social Security Trust funds, and other executive departments on a variety of legal matters.

We caught up with him to get his views on the fiscal matters that have been in the headlines.

FIU Law: What is the “fiscal cliff?”

Gabilondo: This an alarmist metaphor that refers to a package of statutorily-required federal tax increases and spending cuts that kicks in January 2nd of next year, unless Congress can come up with another fiscal plan.  Ironically, this was the solution to a more serious problem: gridlock in Congress over raising the federal debt limit while curbing run-away spending.  A divided Congress punted until after the election by agreeing tax increases and spending cuts that were never expected to see the light of day.  So the package is remarkably fair because it spreads the fiscal burden broadly, balancing conservative and liberal values and putting in place some sound reforms.  Congress didn’t mean to act responsibly, effectively, and in the public interest, but they did.

Gabilondo Appointed to Membership Review Committee of the AALS

FIU Law Professor José Gabilondo, was recently appointed to the Membership Review Committee of the Association for American Law Schools (AALS), the non-profit educational association of law schools whose purpose is “the improvement of the legal profession through legal education,” according to the association’s website.

The committee evaluates applications for membership from law schools to determine if they comply with AALS requirements for teaching, scholarship, and faculty governance.  This appointment grew out of his work on site visit inspections of the American Bar Association (ABA) and membership review inspections of the AALS.  He also participates in training other faculty who participate in accreditation.

This marks Gabilondo’s second appointment to an AALS committee this year. He was also appointed to the AALS Audit and Investment Committee, which participates in the oversight of the Association’s financial practices and organization.

Professor Jose Gabilondo Explains $16 Trillion National Debt

In a recent interview with NBC6 Miami, FIU Law Professor Jose Gabilondo discusses the $16 trillion national debt, and explains the difference between our country’s debt and personal debt.

Professor Gabilondo teaches tax and corporate finance at FIU Law and his scholarship focuses on debt markets. He is a nationally recognized commentator in the Spanish-language media on financial and economic matters and has worked in financial market regulation at the U.S. Department of the Treasury, the U.S. Securities and Exchange Commission, the Office of the Comptroller of the Currency, and the World Bank.

South Florida Professor Explains $16 Trillion Debt

$16,000,000,000,000. That is the number that would appear on the United State’s theoretical credit card statement.

Although the analogy is often made, our country’s debt is not similar to our personal debt, according to Jose Gabilondo, an associate professor of law at Florida International University.

“I can’t borrow indefinitely, you can’t, but the government can. In a way, it’s not the number that matters,” said Gabilondo. “What matters is can you make your monthly payment? And are your creditors still lending to you? The answer for our country, is yes.”
