Professor Foley is the Institute for Justice Chair in Constitutional Litigation and Professor of Law. She also serves as the Executive Director of the Florida Chapter of the Institute for Justice, a public interest law firm based out of the Washington, D.C. area which represents individuals whose constitutional rights have been violated by the government. In this capacity, she litigates claims principally involving economic liberty, free speech, property rights and school choice.

Professor Foley is the author of Liberty for All: Reclaiming Individual Privacy in a New Era of Public Morality (Yale University Press 2006) and The Law of Life and Death (Harvard University Press 2011). Her third book, about the tea party, will be published by Cambridge University Press in early 2012. She is also the author of numerous law journal articles and op-eds and a frequent media commentator, having appeared on or been quoted by The Wall Street Journal, New York Times, Washington Post, Miami Herald, Detroit Free Press, Detroit News, National Law Journal, National Public Radio, Fox News, CNN and the BBC.

She presently serves on the Editorial Board of the Cato Supreme Court Review, an annual publication of the Cato Institute in which leading legal scholars analyze the most important cases of the Supreme Court’s most recent term. She previously served as a member of the Committee on Embryonic Stem Cell Guidelines of the Institute of Medicine, National Academy of Sciences, and as a Fulbright Scholar at the College of Law of the National University of Ireland, Galway.

Professor Foley is one of the “founding faculty” of the FIU College of Law. Prior to joining FIU, she was a Professor of Law at Michigan State University College of Law and an Adjunct Professor at the MSU College of Human Medicine. She previously served as a law clerk to the Honorable Carolyn Dineen King of the U.S. Court of Appeals for the Fifth Circuit and spent several years on Capitol Hill as a health policy advisor, serving as Senior Legislative Aide to U.S. Congressman (now U.S. Senator) Ron Wyden (D-OR), Legislative Aide for the D.C. office of the Health Insurance Plan of Greater New York, and a Legislative Aide for U.S. Congressman Michael Andrews (D-TX).

Professor Foley graduated summa cum laude from the University of Tennessee College of Law, where she was an Articles Editor of the Tennessee Law Review, inducted into Order of the Coif, and valedictorian of her class. She has a B.A. in History from Emory University and an LL.M. from Harvard Law School.

An energetic and innovative classroom teacher, Professor Foley received the “Professor of the Year” award for the 2009-2010 academic year. She teaches courses on constitutional law, civil procedure, and health law/bioethics.
